The agreement governing your use of TrustXP. Please read carefully before creating an account.
These Terms of Service ("Terms") form a binding agreement between you and TrustXP ("Company") regarding your use of our website and the TrustXP trust measurement platform (collectively, "Service"). By creating an account, accessing our platform at https://platform.trustxp.com, or using our Service, you accept these Terms in full.
If you do not agree to these Terms, do not create an account or use the Service.

Account Holder: The individual or entity that creates an account on the Service.
User: Any member of an Account Holder's team who responds to trust pulses.
Pulse: A brief, anonymous survey (2-4 questions, approximately 30 seconds) that measures declared trust perception.
Free Tier: Access for teams of up to 10 members, no credit card required.
Paid Plans: Growth (€99/month), Scale (€249/month), and Enterprise (€499/month) for larger teams, with monthly or annual billing options.
Data: All information you provide or that is generated through your use of the Service, including account information and pulse responses.
Eligibility: You must be at least 18 years old and have the authority to enter into this agreement on behalf of your organization to create an account.
Free Tier Registration: No credit card is required to create a Free Tier account for up to 10 team members.
Account Information: You agree to provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Organizational Authority: By creating an account, you represent and warrant that you have the authority to bind your organization to these Terms and to authorize team members to participate in the Service.
If your team exceeds the member limit of your current plan, you have a 7-day grace period to upgrade to a higher plan or remove team members. If you do not take action within 7 days, pulses will pause until you upgrade or comply with your plan limits. This prevents interruption due to temporary overage.
Paid plans are billed at the frequency you select (monthly or annual). Invoices are sent to the email address associated with your account. You authorize us to charge the payment method you provide on file.
We reserve the right to change pricing with 30 days' notice. Changes do not apply to active subscriptions until the next renewal date.
All sales are final. Refunds are not provided for unused portions of a billing period. If you cancel mid-month, billing access ceases immediately, but no prorated refund is issued.
If payment fails, we will attempt to collect again. After multiple failed attempts, access to paid features may be suspended. You are responsible for keeping your payment information current.
If your paid plan is not renewed or is cancelled, your account automatically reverts to the Free Tier (max 10 members) or is closed if you do not wish to use the Free Tier.
You agree that you will not, and will ensure your team members do not, use the Service for any of the following purposes:
Violation of these acceptable use terms may result in immediate suspension or termination of your account without refund.
Our Content: All content, features, functionality, design, compilation, and code of the Service are the exclusive property of TrustXP or our licensors and are protected by copyright, trademark, and other intellectual property laws.
Your Data: You retain ownership of all data you input into the Service (account information, team data, etc.). You grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your data to deliver the Service.
Pulse Responses: Anonymized pulse response data is used in aggregated form to generate insights and reports. This data cannot be linked back to individuals and remains subject to our Privacy Policy.
Restrictions: You may not reproduce, distribute, modify, or create derivative works from the Service without our express written permission.
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data collection, use, and protection practices.
Key Principles: TrustXP collects only declared trust perceptions through anonymous pulses. We do not track behavior, perform sentiment analysis, or read message content from integrations. All response data is structurally anonymized and encrypted.
GDPR Compliance: If you are located in the EU, our processing of your data complies with GDPR requirements, including data minimization, purpose limitation, and your right to erasure.
Data Deletion: You can delete your account and request deletion of all associated data at any time. Raw pulse data is deleted after aggregation. Aggregated insights are deleted upon account deletion.
As-Is Service: The Service is provided on an "as-is" and "as-available" basis. TrustXP makes no warranties, express or implied, regarding the Service's availability, accuracy, reliability, or fitness for a particular purpose.
No Guarantee of Results: We do not guarantee that using TrustXP will improve trust, engagement, or organizational outcomes. Results depend on how you implement insights and engage your team.
Third-Party Integrations: The Service may integrate with third-party platforms (Slack, Microsoft Teams, Google Analytics, Formspree). We are not responsible for these services' availability, privacy practices, or performance. Use of integrations is subject to their terms of service.
No Professional Advice: Insights and recommendations from the Service are for informational purposes only and do not constitute professional advice (legal, HR, management, psychological, etc.). Consult qualified professionals before making organizational decisions based on our insights.
To the maximum extent permitted by law, TrustXP shall not be liable for:
Total Liability Cap: Our total liability to you in any 12-month period shall not exceed the amount you paid for the Service in that period, or €100, whichever is greater.
You may terminate your account at any time by accessing account settings on the platform or by emailing hello@trustxp.com. Upon termination, you lose access to the Service immediately. No refund is issued for unused portions of a billing period.
We may suspend or terminate your account without notice if you:
Upon termination, all rights granted to you terminate. We may, in our sole discretion, delete your data after a reasonable retention period (typically 30 days). You remain responsible for any outstanding fees or obligations.
We may update these Terms from time to time to reflect changes in our Service, policies, or legal requirements. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after such notification signifies your acceptance of the updated Terms.
Governing Law: These Terms are governed by and construed in accordance with the laws of the Netherlands and the European Union, without regard to conflicts of law principles.
Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of the Netherlands for any dispute arising out of or related to these Terms or the Service.
